wongful action, there is a defense called the insanity defense which never works as most of us know because we don't recognize it. should we recognize it, that's an interesting question. should we have a more robust concept of diminished responsibility in light of the understanding that some people have less control over their preferences and desires or should we have better sentencing schemes or get rid of incarceration and come up with different models of trying to deal with punishment once we understand people have wrong selections. i think those are all interesting questions, but is there free will? well, the fact that almost everybody in the audience raised either their right or left hand contemplated it and were quickly able to act and respond. that to me says, yes, there is. now what do we want to do about it? now that we understand that those of us in the audience or up here that like chocolate cake may not have control over it, how do we want to account for that if at all in the criminal justice system? to date, we haven't. in the future, we may wish to. >> i agree with tha

does not make any difference. the defense has been tried in court. is a civil rights statute. -- it is a civil rights statute. they can be a perfectly legitimate plaintiffs to bring a lawsuit, and there are a number of people who belong to disability organizations that actually, that is what their livelihood is, bringing these lawsuits. the gentleman over here, who was also a lawyer knows of at least one case involving two lawsuits. they started all neighborhoods. the target places like san francisco because this is an old city with old buildings, virtually none of which comply. we only have new construction that would be billed to 1988 compliance standards, usually. whatever kind of business you have, the building part does not enforce ada compliance. you have your architect look at the ada if you are going to make a major revision anyway. is very expensive to do that. the demand letter is a requirment for the state -- is a requirement for the state laws to be brought. for civil rights cases, you are expected to know the law and be in compliance. they do not make a demand under federa

we have people from a cross section with defense lawyers prosecutors, law enforcement, a lot of people on our task force. when we talk to law enforcement one thing that stood out was the law enforcement cannot even detain someone if you shoot someone dead in the streets of florida, and you claim stand your ground, law enforcement can't even detain you under the immunity provision so they can createlyaccurately do an investigation. my task force came out with amend so law enforcement can do their job and investigate the claim of stand your ground. >> eliot: was governor scott semiicsympathetic to that narrow amendment, or did you feel that there was a pre-ordained out come in saying that the law was good as it is. >> definitely. i gave them a copy of my task force which has a cross section of republicans and democrats across the aisle, and they had that in their possession during the whole road show around the state. they never even discussed it. when they put out their report it was never discussed. i don't know how a rational person can think that law enforcement should be able

technique that i have observed that works and is helpful for the department of the defense. talking about a strategy, a broader view, and then through the report get into the details. in the congress, we have all these different committees that claimed some part of the jurisdiction. i had a simple solution. pete, we need some energy legislation and leadership. good luck. every now and then, i would get into his territory and he would teach me a lesson about how far i could get into energy policy because he would come to me and say we have to do this differently. one of the questions i know people will ask -- why are you doing it now? the obama administration will have an opportunity to look at these proposals in november and december and hopefully decide to take advantage of them and use them next year. also i am hopeful and will recommend that this not just be administrative action. congress should implement this, too. beyond that, we will have the proper recommendations with regard to other issues of security, jobs, efficiencies, innovation. this is such an important part of our e

undercut our defense. some of the programs are the great investment programs of the future. energy, etc.. i really hope congress will redeem our homes by dealing with the entitlement reform. the center of local, and i in june introduced a proposal that would take steps to save medicare for the almost 70 million people who will be on medicare in one decade. and reduce the enormous costs of places on our task there. people think the payroll reductions and the premiums they pay pay the total benefits of medicare. it is not so. the average in our lifetime takes $3 out of the system for every dollar they put in. you just cannot run a program long term like that. who picks up the rest? the taxpayers. it is a big part of why we are getting into a deficit. you cannot save medicare by leaving it as it is. you can only save medicare, and i want to, i believe in the program. the senator and i put in a plan that would save over $600 billion in medicare costs over the next dent it -- over the next decade, and reduce medicare unfunded liabilities by $10 trillion. i know our plan contains some st

sequestration in terms of defense cuts. i get entitlements. i get the issue when it comes to taxes. you look at the amount of money this country spends on defense, is it an area where republicans say we can make cuts there as well if you want cuts on entitlements? >> absolutely. we need to make cuts anywhere we can. there are efficiencies we can find in military spending. that doesn't mean that the kind of sequestration called for by the budget act of 2011 is the way to do it. those cuts fall disproportionately on the department of defense and i think that's a problem. i've got a bill in the form of my cut, cap and balance act of 2012 that makes sequestration unnecessary because there are more cuts, some in defense and others in other areas. i have another piece of legislation that i have not yet introduced but am working on. targeted kus so we don't have to carry out all of the cutting in the area of defense or disproportionately in the area of defense. >> i want to bring in u.n. ambassador susan rice, who has a meeting on the hill in the next hour to meet with senators john mccain, li
